Terms & Conditions

By booking a photoshoot with Stillframe Media, you agree to the following terms and conditions. These terms ensure a smooth experience for both the photographer and the client.
1. Booking & Scheduling
Appointments are scheduled seamlessly through our Cal.com portal.
- A non-refundable $50 deposit is required at the time of booking to secure your requested time slot.
- While this deposit is non-refundable, you have the complete flexibility to reschedule your appointment for any available time and day, and your deposit will automatically transfer to the new date.
- Your appointment is considered fully confirmed only upon receipt of this deposit and a final confirmation email.
2. Travel Fees & Service Area
To keep our travel fees transparent and fair, they are calculated based on the driving mileage from our central starting point in San Marco Square: 1986 San Marco Blvd, Jacksonville, FL 32207.
We use Apple Maps to calculate the distance from this address to your property listing, ensuring you can easily verify the distance on your end. Our travel fee zones are as follows:
- 0–20 miles: Free
- 21–35 miles: $35
- 36–50 miles: $60
- 51+ miles: Custom quote (please contact us prior to booking)
3. Pricing, Property Size & Add-Ons
Our pricing tiers are structured based on the total square footage of the property.
- If the actual square footage of the property exceeds the booked pricing tier, Stillframe Media reserves the right to adjust the final invoice to reflect the correct tier.
- The final adjusted invoice must be paid in full prior to media delivery.
- Community & Amenity Photos: Shots of neighborhood amenities (community pools, clubhouses, entrance signs, etc.) are not included in the base property square footage but can be added to any package at a rate of 5 photos for $45 or 10 photos for $75.
4. Property Readiness
The property must be "shoot-ready" upon the photographer's arrival. This includes turning on all lights, opening blinds, removing cars from the driveway, and clearing clutter.
- Photographers are not responsible for cleaning, moving furniture, or decluttering the property.
- If the property is not ready, the shoot may be cancelled or rescheduled at the photographer's discretion, subject to a fee.
5. Pets & Animal Policy
To ensure the safety of our team and your pets, all animals must be secured, crated, or removed from the property prior to the photographer's arrival.
- Photographers will not handle, move, or be responsible for pets during the shoot.
- If a loose or aggressive pet prevents the shoot from occurring safely, the appointment may be cancelled and subject to a trip fee.
6. Property Access & Lockboxes
It is the client's responsibility to ensure the photographer has seamless access to the property at the scheduled appointment time.
- This includes providing accurate gate codes, lockbox combos, or ensuring Supra access is permitted.
- If the photographer cannot access the property after a 15-minute grace period, the appointment will be cancelled, and a standard trip fee will apply.
7. Client Presence & Creative Control
Clients and homeowners are welcome to attend the shoot to provide specific direction or point out key features.
- If the client or a representative is not present during the photoshoot, the photographer's creative interpretation of the property (including composition, angles, and lighting) will be deemed acceptable.
- Any requests for different angles or compositions after the fact will be treated as a subjective re-shoot and will incur a standard fee.
8. Cancellations & Rescheduling
We understand that the real estate industry is unpredictable. To offer you maximum flexibility:
- Rescheduling: You may reschedule your photoshoot for any available time and day without penalty. Your $50 deposit will seamlessly transfer to your new appointment.
- Cancellations: Outright cancellations (without rescheduling) will result in the forfeiture of your $50 non-refundable deposit.
- On-Site Cancellation: If the photographer arrives and the shoot cannot proceed (e.g., no access, property not ready), a full trip fee will apply.
- Weather: In the event of severe weather, we will reschedule at no additional cost. For light rain, interior shots will proceed, and exterior shots may be rescheduled or edited with a Blue Sky Guarantee.
9. Delivery & Payment
Images and standard virtual tours are processed and ready by 10 AM the morning following the photoshoot. Upon completion of the shoot, you will receive an itemized invoice via FOUND.
- Payment & Delivery: Once your FOUND invoice is paid in full, you will be automatically issued a unique download code.
- Retrieving Your Media: You can enter your download code directly on our website's Client Listings page to access your Aryeo listing and download your high-resolution files.
- Video production requires additional editing time and will be delivered within 24-48 hours.
- Specialized Add-Ons such as Virtual Staging, Schematic Floor Plans, and Day-to-Dusk (Twilight) edits may require an additional 24 to 48 hours beyond standard photo delivery.
10. Re-shoots & Revisions
We strive to provide the highest quality media, but we understand that additional requests sometimes arise.
- Subjective Re-shoots: Re-shoots requested due to client preference, changes to property staging after the initial shoot, or weather conditions (if the client opted not to reschedule originally) will incur a standard re-shoot fee.
- Objective Re-shoots: Any re-shoots required due to photographer error, equipment failure, or technical issues will be completed free of charge.
11. Refund Policy
Due to the custom nature of digital photography and media services, all sales are final.
- Once the digital media has been delivered to the client, no refunds will be issued.
- This policy applies regardless of whether the property listing is cancelled, sold, withdrawn from the market, or if the client chooses not to use the media.
12. File Archiving & Hosting
We provide hosting for your media via an online gallery for a period of 6 months following your delivery date.
- After 6 months, files may be permanently deleted from our active servers to make room for new projects.
- It is the client's sole responsibility to download and backup all media immediately upon delivery.
- Retrieval of archived files (if they are still available on our local backups) will incur an unarchiving fee.
13. Virtual Staging & MLS Compliance
Virtual staging is a powerful tool to showcase a property's potential, but it must be used responsibly.
- It is the real estate agent's sole responsibility to ensure that any virtually staged media complies with their local MLS rules, disclosures, and guidelines.
- Stillframe Media provides the edited media but is not liable for any MLS fines, violations, or misrepresentations resulting from their use.
14. Floor Plan Accuracy & Measurements
All schematic floor plans and measurements provided by Stillframe Media are approximate and for illustrative purposes only.
- Floor plans are not drawn to exact scale and should not be relied upon for precise architectural, construction, or legal purposes.
- Stillframe Media accepts no liability for measurement discrepancies or disputes arising from the use of our floor plans.
15. Drone & Aerial Photography
All aerial services are strictly bound by Federal Aviation Administration (FAA) regulations, local airspace restrictions, and weather conditions.
- If a drone cannot be flown safely or legally due to high winds, rain, or restricted airspace (e.g., proximity to airports or temporary flight restrictions), that portion of the service will be cancelled and refunded or omitted from the final invoice.
- The remainder of the scheduled ground photoshoot will proceed as planned.
16. Copyright & Usage Rights
Stillframe Media retains the copyright to all images produced. Upon payment, the client is granted a Limited Licensing Agreement:
- Usage: You may use the images for marketing the specific property listing (MLS, social media, flyers, website) for the duration of the listing.
- Transfer: The license is non-transferable. You may not sell or give the images to third parties (e.g., builders, stagers, designers, other agents) without written permission from Stillframe Media.
17. Promotional Rights & Portfolio Usage
As the copyright holder, Stillframe Media actively updates our portfolio to showcase our latest work.
- Unless explicitly requested in writing prior to the shoot, Stillframe Media retains the right to use any media produced (photos, videos, floor plans) for our own marketing, promotional materials, portfolio, and social media channels.
18. Liability
Stillframe Media is not liable for any injury or damage to property during the photoshoot, except in cases of proven gross negligence. The client ensures that the property is safe for the photographer to enter.
19. Indemnification
The client agrees to indemnify and hold Stillframe Media, its employees, and contractors harmless against any and all claims, liabilities, damages, and expenses (including attorney fees) arising from the use of the delivered media. This includes, but is not limited to, claims of misrepresentation by buyers or third parties.
20. Force Majeure
Stillframe Media shall not be held liable or responsible for any failure or delay in fulfilling our obligations due to events beyond our reasonable control. This includes, but is not limited to, acts of God, severe natural disasters, sudden extreme weather, acts of terrorism, or sudden severe illness. In such events, we will make every effort to reschedule the services at the earliest mutual convenience.
21. Governing Law & Severability
These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Florida.
- If any provision of these terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
